Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding agreement between you ("Customer," "you," or "your") and DestroyNet ("DestroyNet," "we," "us," or "our") governing access to and use of our website, client portal, hosting infrastructure, Cloud VPS platforms, domain registration services, cybersecurity tools, and any related products or support offerings (collectively, the "Services").

By creating an account, placing an order, accessing the Client Area, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into this agreement on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that entity.

If you do not agree to these Terms, you must not use the Services. We may update these Terms from time to time. Material changes will be communicated through the Client Area, email, or a notice on our website. Continued use of the Services after the effective date of revised Terms constitutes acceptance of those changes.

2. Provision of Services

DestroyNet provides enterprise-grade web hosting, Cloud VPS, domain services, and proactive cybersecurity solutions designed for performance, resilience, and defense-in-depth. Service specifications, resource allocations, and feature sets are described in the applicable product documentation and order confirmation at the time of purchase.

Uptime and availability. We operate our infrastructure with commercially reasonable efforts to maintain high availability. Unless otherwise stated in a separate service level agreement applicable to your plan, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, emergency security patching, upstream provider events, and force majeure circumstances may affect availability. We will endeavor to provide advance notice of planned maintenance when practicable.

Support. Technical support is provided according to your service tier through our ticketing system and documented support channels. Support covers platform-related issues within the scope of Services we directly provide. We do not provide unlimited custom development, third-party software debugging, or remediation of issues arising solely from Customer-configured applications unless covered by a separate professional services agreement.

3. Acceptable Use Policy

DestroyNet infrastructure exists to empower legitimate digital operations. You agree to use the Services only for lawful purposes and in compliance with applicable international regulations and industry standards. The following activities are strictly prohibited:

• Hosting, distributing, or facilitating malware, ransomware, spyware, botnets, or any malicious code or payload;
• Initiating, coordinating, or participating in distributed denial-of-service (DDoS) attacks or any form of network abuse;
• Phishing, credential harvesting, fraud, impersonation, or deceptive schemes targeting individuals or organizations;
• Spam, bulk unsolicited messaging, or abusive email practices in violation of anti-spam standards;
• Storage or transmission of content that infringes intellectual property, privacy, or proprietary rights of others;
• Any activity that violates applicable law, facilitates illegal conduct, or exposes DestroyNet infrastructure to reputational or legal harm;
• Attempting to gain unauthorized access to systems, accounts, networks, or data belonging to DestroyNet or third parties;
• Circumventing resource limits, security controls, billing mechanisms, or abuse prevention systems.

We reserve the right to investigate suspected violations, suspend or terminate Services without refund where appropriate, remove offending content, and cooperate with lawful requests from competent authorities. Customers remain solely responsible for all content, applications, and traffic originating from their accounts.

4. Account Security and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, API keys, SSH keys, and any authentication tokens associated with your Services. You must implement strong passwords, enable multi-factor authentication where available, and restrict access to authorized personnel only.

You must promptly notify DestroyNet of any suspected unauthorized access, credential compromise, or security incident affecting your account. Failure to secure your environment may result in unauthorized use for which you remain liable.

You are responsible for securing applications deployed on our infrastructure, including patch management, access controls, database configuration, and backup strategies appropriate to your workload. DestroyNet provides hardened platform layers and security tooling, but shared responsibility applies: we secure the infrastructure; you secure what you deploy upon it.

5. Payment and Billing

Fees for Services are billed according to the pricing, billing cycle, and currency displayed at checkout or in your Client Area invoice. By submitting payment information, you authorize DestroyNet and its payment processors to charge applicable fees on a recurring basis until you cancel in accordance with these Terms.

All fees are due in advance unless otherwise agreed in writing. Late or failed payments may result in service suspension, resource throttling, or termination after reasonable notice. Reactivation may require settlement of outstanding balances and applicable restoration fees.

Refunds are handled according to the refund policy published at the time of purchase. Certain services—including domain registrations, SSL certificates, one-time security remediation, and third-party licensed products—may be non-refundable once provisioned.

You are responsible for all applicable taxes, duties, and governmental charges associated with your purchase, except where DestroyNet is legally required to collect and remit such amounts.

6. Limitation of Liability and Termination

Disclaimer. To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DestroyNet does not warrant that the Services will meet your requirements or operate without interruption.

Limitation of liability. To the maximum extent permitted by law, DestroyNet and its affiliates, directors, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim arising under these Terms shall not exceed the total fees paid by you to DestroyNet for the Services giving rise to the claim during the twelve (12) months preceding the event.

Termination by Customer. You may cancel Services through the Client Area or by submitting a verified support request. Cancellation takes effect at the end of the current billing period unless otherwise specified. You remain responsible for fees incurred prior to effective cancellation.

Termination by DestroyNet. We may suspend or terminate your account immediately if you breach these Terms, engage in prohibited activities, fail to pay amounts due, or if continued provision poses security, legal, or operational risk. Upon termination, your right to access the Services ceases. We may delete Customer data after a reasonable retention period following termination, except where retention is required by law or legitimate business purposes.
